Receivership Orders

The Trust was organized in 1991, pursuant to the State of Illinois' Workers Compensation Act and Section 305 of the Illinois Insurance Code, for the purpose of administering a program of group self-insurance for workers' compensation loss exposures of selected members of the Illinois Association of Environmental Service Companies. The Trust was placed in conservation by a court order entered on July 31, 2000. On March 22, 2001 an Order of Liquidation was entered.

Contractual assessments were issued by the Liquidator to all members of the Trust in order to fund the Trust's outstanding claim and policy obligations. Litigation was required to collect the assessments from many of the Trust's members.

The claim filing deadline was March 22, 2002 for presenting claims in the liquidation proceedings.  The deadline for liquidating contingent claims was March 24, 2003.

On November 2, 2006, the Supervisory Court entered an order approving a 100% distribution to priority level (g) claimants. The court has previously approved a100% distributions to claimants at priority levels (a)-(e).

On November 16, 2006, the supervisory court entered an order setting a new claim filing deadline of May 14, 2007, to afford claimants who did not previously file claims, or who filed claims after the original claim filing deadline, an opportunity to file their claims.

An order approving a 100% dividend distribution on all allowed claims filed on or before the second claim filing deadline on May 14, 2007 was entered by the Supervisory Court on December 13, 2007.

On April 23, 2008, orders were entered by the Supervising Court approving the Liquidator’s Assessment Surplus Refund Plan, closing of the estate and termination of the liquidation proceedings.
