On January 7, 2011, Illinois Director of Insurance Michael T McRaith filed a Verified Complaint for Liquidation of Constitutional Casualty Company in the Circuit Court of Cook County, Illinois, pursuant to the provisions of Article XIII of the Illinois Insurance Code. The Complaint for Liquidation seeks the entry of an Order of Liquidation with a Finding of Insolvency. The Illinois Insurance Guaranty Fund will be triggered for the protection of Constitutional Casualty Company's policyholders in accordance with the provisions of the Illinois Insurance Guaranty Fund Act, in the event that the Order of Liquidation and Finding of Insolvency sought by Director McRaith is entered by the Circuit Court. Under Illinois law, Constitutional Casualty Company has ten days to answer the Verified Complaint. On January 21, 2011, the Circuit Court of Cook County Illinois entered an Agreed Order of Liquidation With A finding of Insolvency against Constitutional Casualty Company. The Agreed Order of Liquidation has triggered the protection of the Illinois Insurance Guaranty Fund in accordance with the provisions of the Illinois Insurance Guaranty Fund Act. Policies that do not otherwise expire on an earlier date, and that are covered by the Illinois Insurance Guaranty Fund, shall be cancelled effective 11:59 p.m., Central Standard Time, on February 20, 2011. Any policy that is not covered by the Illinois Insurance Guaranty Fund was cancelled upon the entry of the Agreed Order of Liquidation.
